Terms of Service

These Terms govern your use of the HonestID app and related services, provided by Honest Identity Ltd (“HonestID”, “we”, “us”), a company registered in England and Wales under number 16999205, with its registered office at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. By creating an account or using the app, you agree to these Terms. If you do not agree, do not use HonestID.
Our Privacy Policy explains what we do with your data and forms part of these Terms.
Eligibility
You must be at least 16 years old and able to form a binding contract to use HonestID. If you are using HonestID for an organisation, you confirm you are authorised to accept these Terms on its behalf, and “you” means both you and that organisation.
What HonestID is, and what it is not
HonestID provides real-time identity assurance to help you confirm you are communicating with the genuine person. It is a tool to support your own judgment, not a replacement for it.
HonestID confirms that the person on the other end holds a specific HonestID account and can answer what only they should be able to answer. It does not verify government-issued identity documents, it does not guarantee that any person is who they claim to be, and it cannot detect every impersonation attempt. A passed verification is evidence, not proof.
You remain responsible for your own decisions, including any decision to transfer money, share information or grant access. Do not use HonestID as the only control on a high-value or irreversible action.
Your account and your device
Your account is bound to a single device and unlocked with your device biometrics. You are responsible for keeping your device and your account secure, and for everything done under your account. If you change or lose your device, use the device transfer flow in the app. Tell us promptly at support@honestid.io if you believe your account has been used without your permission.
Keep your account details accurate and up to date. Your name and email address are shown to your contacts.
Acceptable use
You agree not to:
- Use HonestID for any unlawful, harmful or fraudulent purpose;
- Impersonate another person, misrepresent your identity, or register an account in someone else’s name;
- Attempt to access accounts, data or systems you are not authorised to access;
- Interfere with or disrupt the service, probe or circumvent its security, or reverse-engineer, decompile or modify the app except to the extent the law says you may;
- Use automated means to create accounts or send verification requests in bulk, or use HonestID to harass someone with repeated requests;
- Add or invite people who have not agreed to hear from you, or provide an email address you have no right to give us;
- Send abusive, threatening, obscene or otherwise objectionable content in the free-text note attached to a verification, or in any other field shown to another person.
Content you send to other people
The short note you attach to a verification, and the name shown on your account, are seen by the person you are verifying with. You are responsible for that content and you must keep it lawful and inoffensive.
We have no tolerance for objectionable content or abusive behaviour. A verification request can only come from someone in your contacts, so deleting a contact stops them reaching you, and you can do that from the app at any time. You can report someone from their contact screen, or email support@honestid.io. We aim to act within 24 hours, which may include removing content and suspending or terminating the account responsible.
Availability and changes to the service
HonestID is currently offered free of charge while we run early pilots and gather feedback. We may change, add or remove features, and we may introduce paid plans in future, in which case we will make the terms clear before you pay anything. We do not promise any particular level of availability, and we may suspend the service for maintenance or for security reasons.
Suspension and termination
You can stop using HonestID and delete your account at any time from within the app. See Delete Your Account. Deletion is immediate and permanent.
We may suspend or terminate your account if you breach these Terms, if your use puts the service or other users at risk, or if we are required to by law. Where it is reasonable to do so, we will tell you why and give you a chance to put it right. If we discontinue the service entirely, we will give you reasonable notice so you can delete your account first.
Intellectual property
HonestID and its associated software, branding and content are owned by Honest Identity Ltd and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for its intended purpose, in line with these Terms. We reserve all other rights.
If you send us feedback or suggestions, we may use them freely and without obligation to you. You keep any rights you have in the content you send to other people through HonestID, and you grant us the limited licence needed to deliver it to them and operate the service.
Apps distributed through the App Store
These Terms apply to the version of HonestID you download from a third-party app store. Where you obtained the app from the Apple App Store, the following also applies:
- These Terms are between you and Honest Identity Ltd only, not with Apple. Apple is not responsible for HonestID or its content.
- Your licence to use the app is limited to Apple-branded products you own or control, as permitted by the App Store Usage Rules.
- We are solely responsible for support and maintenance. Apple has no obligation to provide either.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price you paid. Apple has no other warranty obligation, and any other claims arising from a failure to conform are our responsibility.
- We, not Apple, are responsible for any claim relating to the app, including product liability, any failure to comply with legal or regulatory requirements, consumer protection and privacy claims, and any claim that the app infringes a third party’s intellectual property rights.
- You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government prohibited or restricted party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Questions, complaints or claims about the app should be sent to support@honestid.io.
Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranty of satisfactory quality, fitness for a particular purpose or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will detect every impersonation attempt.
Nothing in these Terms affects your statutory rights as a consumer, which cannot be excluded or limited.
Limitation of liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
Subject to that, and to the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the service, nor for loss of profit, revenue, business, goodwill or data, nor for any loss resulting from a fraud, impersonation or other attack that HonestID did not prevent or detect.
Subject to the paragraph above, our total liability to you for all claims arising out of or relating to these Terms or the service is limited to the greater of the amount you paid us in the 12 months before the claim arose and £100.
Indemnity for business users
If you use HonestID other than as a consumer, you agree to indemnify us against claims, losses and costs arising from your breach of these Terms, your misuse of the service, or content you send through it.
Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above always reflects the current version. Before a material change takes effect we will take reasonable steps to tell you, by email or in the app. If you continue to use HonestID after that, you accept the updated Terms. If you do not accept them, delete your account.
General
If any part of these Terms is found unenforceable, the rest continues to apply. A delay in enforcing a right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a company that takes over our business, provided your rights are not reduced. These Terms, together with the Privacy Policy, are the entire agreement between us about the service. Nobody other than you, us and the third-party beneficiaries named above has any rights under these Terms.
Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction. If you are a consumer resident elsewhere in the UK or in the EU, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there.
